Terms of service

These terms govern your use of FirstFlag ("we", "us"), a subscription intelligence service. By subscribing or using a territory portal you agree to them. Questions to hello@firstflag.co.

FirstFlag analyses publicly available regulatory and company data for care homes in your licensed territory and flags homes showing defined risk signals, together with named directors and contact details drawn from public records. The service is built from CQC's published register and refreshed as that register updates.

The licence is a one-off build fee plus a monthly subscription fee, billed monthly in advance and rolling with no minimum term. Both figures are quoted to you in writing before you pay, and the amounts on that quote are the amounts that apply. The first payment combines both; every payment after that is the monthly fee alone. The build fee covers the initial assembly and research of your territory and is not refundable once that work has been delivered. You may cancel the monthly subscription at any time and it ends at the close of the paid period. If you cancel, the rate you were quoted is not guaranteed on re-subscription.

Individual dossiers may be bought separately at the price quoted to you. A dossier purchase covers that dossier only and confers no territory rights. Dossiers already bought in a territory are credited against a licence of that territory.

Your licence is for internal business development use by your firm. You may not resell, republish or redistribute FirstFlag data or reports, or share portal access outside your firm. Underlying public-register data remains subject to its own licences (Open Government Licence v3 for CQC data).

FirstFlag is decision-support, not advice. Signals are derived from public records that can lag reality, and we do not warrant that any flagged home will fail, improve or engage you. The service is provided "as is". To the fullest extent permitted by law our total liability under these terms is capped at the fees you paid in the twelve months before the claim. Nothing in these terms limits liability for fraud or for death or personal injury caused by negligence.

We may suspend or end the service for non-payment or material breach of these terms. We may retire the service with thirty days' notice, in which case any prepaid period beyond the closure date is refunded pro rata.

These terms are the whole agreement between us regarding the service. If any part is found unenforceable the rest stands. We may update these terms; material changes will be notified to subscribers by email. These terms are governed by the law of England and Wales and the courts of England and Wales have exclusive jurisdiction.
